Claims of family members

Family members are compensated for the loss of care, guidance and companionship that they have suffered as a result of a death or injury to a loved one. Currently claims for loss of care, guidance and companionship are subject to a monetary deductible of $15,000 on awards less than $50,000. Family members can also be compensated for the value of nursing services and other attendant care services provided to their loved one after an injury.

In cases involving the death of a family member, the surviving family members are entitled to make claims for the loss of income suffered by the family and the loss of household services.
